Trademark Victory for El Carmen / Amerisal Foods

We’re thrilled to share a significant legal victory for our client El Carmen, Inc., the holding company behind Amerisal Foods, known for its PERLA brand of Salvadorean cheeses and Latin American food products.

In the case of El Carmen, Inc. et al v. Eliseo Rubio et al, Nolan Heimann partner David Hoffman successfully defended the company’s rights to the PERLA, LA PERLA, and related trademarks. The defendants had claimed ownership of the marks and submitted thousands of receipts in an attempt to support their position. However, David and the team were able to demonstrate that the receipts were not trustworthy—ultimately preserving the company’s longstanding trademark registrations.

The PERLA brand has been a staple in the community for over 20 years, now widely available through retailers like Costco and other major grocery stores. This win ensures that El Carmen / Amerisal Foods can continue to grow with its IP firmly protected.
